GetGo Technologies Pte Ltd, UEN 202024592Z, is a company incorporated in Singapore with its registered address at 55 Ayer Rajah Crescent #07-18 Singapore 139949 (“GetGo”).
GetGo is the owner and operator of the GetGo Mobile Application (the “App”) that provides an online platform to facilitate the booking of vehicles between owners and hirers for leisure use.
This document stipulates the Terms and Conditions (this “Agreement”) between GetGo and you, the vehicle user (“Hirer”).
For bookings involving an authorized Additional Driver (“Co-drive bookings”), the term “Hirer” shall refer to both the Primary Driver and the Additional Driver jointly and severally. Both parties acknowledge and agree to be bound by all terms and conditions of this Agreement as if they were the sole Hirer. Any act, omission, or breach of this Agreement by one party shall be deemed a breach by both.
By using the GetGo App, the Hirer acknowledges that he or she has read, understood, and unconditionally agree to be bound by the Terms and Conditions set forth in this Agreement.
The Hirer accepts that GetGo reserves the right to modify these Terms and Conditions at any time at its sole discretion. All changes to the Terms and Conditions will be incorporated directly into the Terms and Conditions that may be found at https://getgo.sg/terms-conditions/. The Hirer’s use of the GetGo App to reserve, book, or use of the vehicle through GetGo App after such changes have been incorporated will constitute the Hirer’s agreement to the modified Terms and Conditions and all the changes. The Hirer therefore undertakes to read the Terms and Conditions carefully each time before using the GetGo App and agrees to bear the risks of not doing so. The Hirer’s continuous use of the GetGo App amounts to its acceptance of all the amendments to the Terms and Conditions. For the avoidance of doubt, GetGo does not undertake otherwise to inform the Hirer of any changes to the Terms and Conditions.
HENCEFORTH
It is agreed between GetGo and the Hirer as follows:
1. Eligibility to use the GetGo App
1.1. The Hirer must either be (i) least nineteen (19) years of age and have held a valid driving license for at least twelve (12) months prior to the use of the GetGo App, or (ii) above twenty-five (25) years of age and possesses a valid driving license.
1.2. Hirers who are not Singapore Citizens or Permanent Residents must have a valid work or study pass issued by the Ministry of Manpower. They must possess:
1.2.1. a valid Foreign Driving licence and International Driving Permit; or
1.2.2. an official translation of your foreign driving licence in English if an IDP is not available.
1.3. The Hirer must possess a valid credit card, debit card, or PayLah! account that is accepted by GetGo and the GetGo App.
1.4. The Hirer must have the mental and physical capacity to competently, safely, and lawfully operate a motor vehicle.
1.5. The Hirer must not owe GetGo any money.
1.6. The Hirer must not be a bankrupt, be facing bankruptcy charges, or have been declared a bankrupt.
2. GetGo Mobile Application and Vehicle Use
2.1. The GetGo App is primarily used to reserve, book, unlock and lock vehicles that are available on GetGo’s online platform.
2.2. Subject to the vehicles’ availability and GetGo’s reservation and advance booking policies, the Hirer may reserve or use the vehicle only in Singapore, save for an Authorised DTM Booking made in accordance with Section 9 and Schedule 2.
2.3. The Hirer will not permit anyone other than himself or herself to use the registered GetGo account or operate the vehicle during the term of the booking. Notwithstanding the foregoing, a Hirer (the "Primary Driver") may invite one (1) other registered GetGo user (the "Additional Driver") to share driving responsibilities for a specific booking. The Additional Driver must manually accept the invitation within the App for the Co-drive booking to be valid and must meet all eligibility requirements to use the GetGo App as stipulated in Section 1.
2.4. The Hirer will not use, or permit anyone to use, the vehicle for any purpose that it is not expressly designed or allowed for use (as stipulated in this Agreement) for.
2.5. The Hirer will not use, or permit anyone to use, the vehicle for any commercial, subleasing, racing, driving instruction / tuition, private hire, towing, pace-making, off-road driving, and/or competition in any form of motorsport or any illegal purpose whatsoever.
2.6. The Hirer shall not use or operate the vehicle, or permit anyone to use or operate the vehicle:
2.6.1. under the influence of alcohol or any intoxicating substance;
2.6.2. to carry hazardous or dangerous materials;
2.6.3. to intentionally, negligently, or in any way or for any reason expose the vehicle to danger or risk including damage, and vandalism; and/or
2.6.4. for any illegal purposes and/or in contravention of the laws of the applicable country including Singapore.
2.7. The Hirer agrees that he or she is responsible and liable to GetGo for: (i) all legal costs and expenses incurred by or on behalf of GetGo on a full indemnity basis, to pursue legal and/or settlement proceedings arising out of a breach of this Agreement by the Hirer; and (ii) any loss and/or damages arising from the loss of use or loss of or damage to the vehicle for any reason whatsoever, arising out of and in connection with a breach of this Agreement by the Hirer.
2.8. Without limiting the scope and effect of Clause 2.7, the Hirer shall be fully responsible for all costs, expenses and fees (including Vehicle recovery expense) and damages arising from loss of use of a vehicle, a breach of this Agreement or the occurrence of the following which includes but not limited to:
2.8.1. vehicle accident, fire, theft and any loss caused to the vehicle;
2.8.2. fuel, charging and parking charges, Electronic Road Pricing (ERP) fees, and traffic and parking fines;
2.8.3. vehicle being seized, forfeited to or confiscated by the authorities;
2.8.4. reckless or negligent operation of the vehicle; and
2.8.5. operating the vehicle under intoxication.
2.8.6. For overseas towing, recovery, detention, and seizure costs specific to an Authorised DTM Booking, see Schedule 2.
2.9. For Co-drive bookings, both the Primary Driver and the Additional Driver shall be jointly and severally liable for all costs, expenses, and damages as set out in Clauses 2.7 and 2.8 above. The Primary Driver remains responsible for ensuring full payment of all invoices, excess claims, loss of use, administrative charges, penalties, fees, and recovery demands arising from the booking. GetGo reserves the right to recover any outstanding amounts from the Additional Driver associated with the booking, including in the event of default or death of the Primary Driver, regardless of whether the Primary Driver or the Additional Driver was operating the vehicle at the material time.
2.10. A Primary Driver may only add one Additional Driver per booking, and this must be done during the initial booking process. The removal of an Additional Driver is strictly prohibited once a booking has commenced.
2.11. The Hirer shall not remove or interfere with any decals, marks, plates, or accessories affixed to the vehicle including but not limited to GetGo identification decals on the vehicle, in-car camera including their SD cards, and mobile phone holders.
2.12. The Hirer acknowledges that where a fuel card is made available in the GetGo vehicle, it shall only be used for the refuelling of the GetGo vehicle that the card came with. For the avoidance of doubt, the fuel card shall not be used to refuel any other vehicle or for any other purposes other than refuelling the GetGo vehicle that it came with.
2.13. The Hirer acknowledges that the charging function is included in the GetGo app, it shall only be used for the charging of the GetGo vehicle that was booked. For the avoidance of doubt, the charging function shall not be used to charge any other vehicle or for any other purposes other than charging the GetGo vehicle.
2.14. The Hirer acknowledges that (i) the provision of an in-car camera is solely for the benefit of GetGo's use, and not for the Hirer's benefit, (ii) GetGo does not warrant the working condition of any in-car cameras, that are provided only for GetGo's sole benefit, and (iii) the Hirer accepts that the non-availability or faulty condition of any in car camera does not constitute any breach by GetGo’s terms and conditions of the Agreement, and does not constitute a waiver of any of GetGo's rights against the Hirer.
2.15. GetGo may suspend or restrict the Hirer's account pending investigation of any suspected fraud, misuse, or breach of this Agreement.
3. Vehicle Collection and Return
3.1. It is the Hirer's responsibility to ensure their eligibility to access the location to collect the vehicle. GetGo shall not be responsible for any booking cancellations resulting from the Hirer's inability to access the location. For Co-drive bookings, only the Primary Driver shall have the authority and functionality within the App to start the booking.
3.2. The Hirer shall unlock and inspect both the interior and exterior of the vehicle before driving or moving off from the designated GetGo parking space, for the following:
3.2.1. evidence of physical damage to the vehicle;
3.2.2. evidence of vehicle malfunction; and
3.2.3. evidence of gross compromise to cleanliness of the vehicle.
3.3. In relation to Clause 3.2, the Hirer must inform GetGo via the submission of relevant photographs on the App, of any evidence of such damage, malfunction, and/or gross compromise to cleanliness of the vehicle.
3.4. The Hirer is deemed to be satisfied with the vehicle’s condition if there are no photographs relating to the above that are submitted, and/or if there are insufficient photographs with clear evidence of any of the above (as mentioned in Clause 3.2) submitted via the App, as soon as the vehicle has moved off from the designated GetGo parking space.
3.5. Upon completion of the booking, the Hirer must return the vehicle to the vehicle’s designated GetGo parking space (Point A to Point A) in a condition that is similar to or better than when the vehicle was first collected.
3.6. GetGo reserves the right to impose penalties and applicable charges if the vehicle is returned late, in an unsatisfactory condition, and/or not to its designated lot, at GetGo’s full and sole discretion.
3.7. Unless otherwise instructed by GetGo, all penalties and charges paid to GetGo shall be made and/or charged unilaterally by GetGo against the Hirer’s debit / credit card, by cheque to GetGo Technologies Pte Ltd, or via PayNow to 202024592Z.
3.8. Before ending the booking, the Hirer must complete an inspection of the vehicle like that detailed in Clause 3.2, and report any:
3.8.1. evidence of physical damage to the vehicle;
3.8.2. evidence of vehicle malfunction; and
3.8.3. evidence of gross compromise to cleanliness of the vehicle.
3.9. In relation to Clause 3.8, the Hirer should document the inspection of the vehicle via the App, paying particular attention to any evidence of physical damage, indication of vehicle malfunction, and/or the cleanliness of the vehicle.
3.10. Upon ending the booking, unless otherwise reported via the App, the Hirer is deemed to have inspected the vehicle, and considered the vehicle to be in a similar or better condition than when the vehicle was first collected by the Hirer.
3.11. For Co-drive bookings, only the Primary Driver shall have the authority and functionality within the App to (i) end the booking, (ii) extend or cancel the booking, and (iii) perform and submit all mandatory reports and photographs.
3.12. The Hirer accepts that he or she may become liable for any fees, expenses, penalties and/or damages incurred, imposed or ordered as a result of damage, malfunction, and/or gross compromise to cleanliness of the vehicle, if the Hirer does not possess photographs to substantiate the fact that any alleged damage, malfunction, and/or gross compromise to cleanliness to the vehicle was not caused by him or her.
3.13. The Hirer must return the vehicle to its designated parking space together with all its tyres, accessories, and equipment, as per the state of the vehicle at the point that the vehicle was first collected by the Hirer.
3.14. The Hirer agrees to abide by the Community Guidelines set out in Schedule 1 and accepts the penalties, charges, and implications should he or she be found to have breached any of the guidelines.
3.15. The Hirer agrees that GetGo will not be liable for any items left in the vehicle during and after their booking; any items found and handed to GetGo may be handed over to the relevant authorities or after being held for sixty (60) days, be discarded, donated, or auctioned off.
4. Breakdown, Damage & Accident Reporting
4.1. The Hirer must immediately report a breakdown of the vehicle to GetGo or its partners through the App or the designated reporting phone line and ensure that the vehicle and the Hirer are in a safe place while waiting for vehicle recovery and/or replacement of the vehicle.
4.2. The Hirer acknowledges that the issues listed below are preventable through the careful, proper, and correct use of the vehicle, and do not constitute a “breakdown” for the purpose of this Agreement:
4.2.1. immobilisation of the vehicle due to an empty fuel tank or a flat EV battery; and
4.2.2. any fault as a result of negligent use of the vehicle’s components, mechanical parts, and/or computer or electronic system.
4.3. In the event of a breakdown, GetGo may provide the Hirer with a replacement vehicle, refund the relevant booking fees via the issuance of a promo code, or a combination of both or any other options which shall be decided by GetGo at its sole discretion.
4.4. In the event of a damage or accident, the Hirer must take reasonable efforts to:
4.4.1. inform GetGo or its partners, of the accident via the App or the designated reporting phone line as soon as possible;
4.4.2. not admit any fault or liability for the accident;
4.4.3. obtain the vehicle registration number(s) of the relevant vehicle and contact information of the involved parties and witness(es) to the accident, including the relevant parties’ name(s), NRIC/ID number(s), and contact details.
4.4.4. take photographs of the damage done to the GetGo vehicle;
4.4.5. take photographs of the damage done to the other party’s vehicle(s), if applicable;
4.4.6. take photographs of the damage done to any property affected by the accident, if applicable;
4.4.7. file a report to an appointed accident reporting centre or with the appointed accident response representative within 24 hours of the accident occurrence.
4.4.8. cooperate with GetGo to provide the necessary information and assistance as GetGo may require; and
4.4.9. file a police report if any parties sustain an injury.
4.5. The Hirer will be liable for any incidental costs arising out of an accident, including but not limited to fees and costs incurred for vehicle recovery, towing services, "Loss of Use" (defined as the loss of use, loss of revenue, business interruption, fleet reallocation costs, and any other reasonable operational losses incurred by GetGo), and/or fines imposed by the relevant authorities.
4.6. Subject only to the determination by an appropriate authority that an accident was not caused and/or attributed to the fault of the Hirer, the Hirer acknowledges that in the event of an accident, he or she shall become immediately liable for the following:
4.6.1. Where insurance proceeds are unavailable, denied, reduced, or otherwise insufficient to fully indemnify GetGo for any loss attributable to the Hirer, the Hirer shall remain liable for the balance of all losses suffered by GetGo.
4.6.2. The Hirer shall also be liable for any diminution in the market or resale value of the vehicle arising from structural or major accident damage.
4.6.3. towing fees
4.6.4. the full repair cost
4.6.5. any insurance excess payable as a result of the accident
4.6.6. Any administrative fees
4.7. Notwithstanding the joint nature of a Co-drive booking, GetGo reserves the absolute right, at its sole and private discretion, to:
4.7.1. Hold both the Primary Driver and the Additional Driver collectively liable for any fees, damages, or breaches; or
4.7.2. Hold only one party (either the Primary Driver or the Additional Driver) solely liable, should GetGo determine, based on its internal investigation or external evidence (e.g., traffic camera footage or telematics), that the breach was the exclusive responsibility of that party.
4.7.3. recover any outstanding amounts from the Additional Driver, especially in instances where the Primary Driver defaults on payment
4.8. For Co-drive bookings, the Primary Driver and the Additional Driver shall be jointly and severally liable for all costs, expenses, and sums payable arising from a breakdown, damage, or accident as set out in Clauses 4.5 and 4.6 above.
4.9. While GetGo will bill the Primary Driver by default for such costs, GetGo reserves the right to recover any outstanding amounts from the Additional Driver, especially in instances where the Primary Driver defaults on payment or where the Additional Driver was the operator of the vehicle at the material time of the accident or damage.
4.10. GetGo will not be responsible for any incidental costs incurred by the Hirer as a result of an accident or a breakdown of a vehicle, including but not limited to any taxi fares incurred by the Hirer due to a vehicle breakdown or accident.
4.11. In a Co-drive booking, the Primary Driver remains contractually obligated to ensure that any accident involving the Additional Driver is reported to an appointed accident reporting centre within twenty-four (24) hours of the occurrence, as stipulated in Clause 4.4.7. Notwithstanding that the Additional Driver may have been operating the vehicle at the material time , any failure to report the accident within the prescribed timeframe shall be deemed a breach by both the Primary and Additional Driver. In such an event, the Primary Driver acknowledges that all insurance coverage and Collision Damage Waiver (CDW) benefits shall cease to apply , and the Primary Driver shall be held primarily responsible for all resulting costs, repair fees, and administrative charges.
4.12. In the event where the Hirer fails to report the accident or any damages sustained during the booking, to the appointed Accident Reporting Centre as required in Clause 4.4.7 or fails to provide the necessary information and assistance to GetGo as required in Clauses 4.4.1 to 4.4.9, all insurance coverage will cease to apply and the Hirer will become liable for the full cost of the accident and any incidental costs arising from the accident as stipulated in Clause 4.5.
4.13. Loss of use charges are determined by the vehicle’s Sat/ Sun and Public Holiday full day rate.
4.14. GetGo shall on each occasion furnish to the Hirer an invoice as to the amount of the total cost and the sum payable by the Hirer as soon as practicable after such total cost and the sum payable by the Hirer shall have been ascertained and in the absence of manifest or mathematical error or fraud shall such invoice shall be conclusive of the fees payable by the Hirer as set out in Clause 4.6 of this Agreement.
5. Booking Fees
5.1. All fees are in Singapore dollars and are subjected to prevailing Goods and Services Tax (GST).
5.2. Time Charge is calculated on a part thereof basis for the first hour of the booking, and in fifteen (15) minutes blocks on a part thereof basis for subsequent time after the first hour. No refunds will be given for unused Time Charge.
5.3. In addition to the Time Charge, a Mileage Charge is payable based on the distance (in kilometres) driven during the booking period.
5.4. The calculation of Mileage Charge is derived through the vehicle’s odometer record whereby the mileage driven is defined as the “end trip mileage record” less the “start trip mileage record”.
5.5. The Time Charge and Mileage Charge varies for different vehicle tiers, time, and day of booking.
5.6. A flat fee of $3.00 (the "Additional Driver Fee") shall apply to any booking where an Additional Driver invitation is accepted. This fee is strictly non-refundable once the booking commences.
5.7. A Platform Fee will be charged for each booking. Promo codes do not apply to this fee.
5.8. For bookings where the Hirer has opted in to Drive to Malaysia (DTM), a cross-border surcharge of thirty percent (30%) of the Time Charge applicable to the booking shall apply (the "DTM Surcharge"). The DTM Surcharge is subject to a maximum daily cap that varies according to the vehicle tier and whether the day of the booking falls on a weekday, weekend, or public holiday. The applicable DTM Surcharge and daily cap for a given booking shall be as displayed on the GetGo App at the time of booking, and may additionally be found on GetGo's website for reference. The Hirer acknowledges that GetGo reserves the right to modify the DTM Surcharge, the applicable caps, and any related rates at any time at its sole discretion, and the Hirer's continued use of the GetGo App will constitute agreement to the modified terms.
5.9. Notwithstanding the mileage charge provisions above, no mileage charge shall apply to an authorised “Drive to Malaysia” booking. The Hirer shall be solely responsible for all fuel costs incurred during this booking, including fuel purchased in Singapore and Malaysia, and shall not be entitled to any fuel reimbursement.
5.10. Unless otherwise instructed by GetGo, the Hirer will pay for the booking fees, including the time and mileage charges, platform fee and Additional Driver fee incurred during the booking period as booked on the App.
5.11. The Hirer acknowledges and agrees to allow GetGo to charge the relevant booking fees to any payment method added to their account via the App.
5.12. When adding a credit or debit card to the GetGo App, an authorisation amount of SGD 1 may be held against the Hirer’s card for card validation purposes. GetGo will instruct the card’s issuing bank to release this amount after seven (7) days and the issuing bank, at its discretion, will subsequently release the held amount.
5.13. Upon confirmation of a booking, GetGo will charge the booking’s Total Time Charge against the Hirer’s debit / credit card.
5.14. Should the Hirer’s booking be extended either by him or herself the Total Time Charge of the extension duration will be charged immediately.
5.15. At the end of the booking, the Total Mileage Charge for the booking will be charged to the Hirer’s debit / credit card.
5.16. In the event that any invoice issued to the Hirer contains any miscalculation, typographical errors, inaccuracies or omissions, GetGo reserves the right to carry out any such measures as GetGo deems appropriate including without limitation correcting the said errors, inaccuracies or omissions:
5.16.1. For shortfalls in payment, additional amounts shall be charged to the Hirer.
5.16.2. In the event of overpayments, excess amounts shall be refunded to the Hirer.
5.17. Should there be a failure to charge the Hirer’s debit card, credit card, or PayLah! account due to insufficient balance at the end of a booking, a $20 administrative fee will be imposed on the Hirer in addition to any amount due to GetGo.
5.18. The Hirer shall indemnify GetGo for all reasonable costs incurred in recovering outstanding sums, including legal fees, debt collection fees, tracing costs, court filing fees, and enforcement costs.
5.19. The Hirer shall reimburse GetGo for all associated bank fees, chargeback costs, investigation costs, and administrative expenses incurred by GetGo where a chargeback initiated by the Hirer in respect of a valid charge under this Agreement is unsuccessful or subsequently reversed.
5.20. GetGo may, at its sole discretion, set off or deduct any amount owing by the Hirer against any credit balance, wallet balance, promotional credit, refund, or any other amount payable by GetGo to the Hirer.
6. Reservation Extensions, Amendments, Cancellation, and No Show
6.1. The Hirer may reserve a vehicle up to thirty (30) days in advance from the planned collection time for a maximum of five (5) days per booking.
6.2. After making a booking or while a booking is in progress, subject to the vehicle’s availability, the Hirer may opt to extend the booking. This extension may not exceed the maximum booking period of five (5) days.
6.3. For an extension to be successful, the Hirer must have sufficient debit card / credit card / PayLah! balance.
6.4. Cancellations of the reservation may be done at no cost, up to forty-eight (48) hours before the planned collection time. The amount of Total Time Charge will be refunded accordingly.
6.5. Subject to the availability of the vehicle beyond the initial reservation period, the Hirer may extend the reservation period of the vehicle via the App.
6.6. Any cancellations made between forty-eight (48) hours and one (1) hour of the planned collection time, both hours inclusive, will constitute an early cancellation where the Hirer will automatically be charged the first hour of the booking plus 20% of the total time charge of the remaining booking period. No mileage charge will apply as the vehicle has not been driven.
6.7. Any cancellations made within fifty-nine (59) minutes before the collection time, will constitute a late cancellation where the Hirer will automatically be charged the first hour of the booking plus 50% of the total time charge of the remaining booking period. No mileage charge will apply as the vehicle has not been driven.
6.8. Unless a cancellation has been made, the booking period is deemed to have commenced at the reserved start time and the entire time charge for the entire booking period will apply.
6.9. The Hirer acknowledges and agrees that GetGo may charge the relevant extension, amendments, cancellation, and booking usage fees to the credit or debit card linked to their account on the App upon cancellation or completion of the booking period.
7. Late Return
7.1. By the end of the Hirer's scheduled end booking time, the Hirer must have returned the vehicle to its designated home lot, completed and uploaded post-trip condition photos, and ended the booking via the App.
7.2. For Co-drive bookings, even if the Additional Driver physically returns the vehicle, only the Primary Driver has the ability to "End Booking" via the App. Failure by the Primary Driver to end the booking on time will result in late return fees as defined in Clause 7.2.
7.3. A late return fee of $15 shall be imposed if the Hirer ends the booking more than 15 minutes after the scheduled end time. Thereafter, an additional fee of $15 shall apply for each subsequent 15-minute block or part thereof.
7.4. For Co-drive bookings, both the Primary Driver and the Additional Driver shall be jointly and severally liable for any late return fees incurred, regardless of which driver was operating the vehicle at the scheduled end time.
7.5. In such a situation, the Hirer acknowledges and agrees that GetGo may charge the relevant fees at its sole discretion, to the credit card, debit card, or PayLah! Account or available payment method linked to their account on the App.
8. Insurance, Excess, and Collision Damage Waiver
8.1. Subject to the exceptions and specific terms and conditions of the policy providing coverage, the Hirer will be covered by motor insurance for the duration of their booking period including any goodwill grace period awarded by GetGo.
8.2. Drivers below twenty-three (23) years old are considered “young drivers”. Higher insurance excess will apply.
8.3. Drivers seventy (70) years of age and above are considered “senior drivers”. Higher insurance excess will apply.
8.4. Drivers with less than two (2) years of driving experience are considered “new drivers”. Higher insurance excess will apply; driving experience is determined by the date of issuance of the Hirer’s Singapore driving license.
8.5. For Co-drive bookings, the insurance coverage and applicable excess ceiling are determined by the driver with the higher risk profile. If either the Primary Driver or the Additional Driver meets the criteria stated in clauses 8.2, 8.3 and 8.4, higher insurance excess shall apply to the entire booking period regardless of who was driving at the material time.
8.6. For authorised Drive to Malaysia bookings, the CDW charge applicable to the booking shall be doubled relative to the standard Singapore charges for the relevant vehicle tier and CDW option selected.
8.7. Hirers who are not Singapore Citizens or Permanent Residents, have a valid work or study pass issued by the Ministry of Manpower but do not have a valid Singapore driving licence will be considered “new drivers”. Higher insurance excess will apply. Driving experience is determined by the date of issuance of the Hirer’s Singapore driving license.
8.8. Subject to the excess ceiling, the policy protects the Hirer against liability for damage to the GetGo vehicle. Details on the applicable excess ceiling and rates are available on the GetGo Insurance Excess FAQ page, found on our website. The Hirer acknowledges that GetGo reserves the right to modify the terms, rates, and ceilings set out in the Insurance Excess FAQ page and the App at any time at its sole discretion, and the Hirer's continued use of the GetGo App will constitute agreement to the modified terms.
8.9. Subject to the excess ceiling, the policy also protects the Hirer against third party liability caused by or arising out of their use of the GetGo vehicle in accordance with the terms of the agreement, in respect of death, personal injury and/or damage to property suffered by such third party, pursuant to the Third Party (Risks and Compensation) Act (Cap. 395).
8.10. Promo codes do not apply to the CDW charges.
8.11. The Hirer acknowledges and agrees to the excess ceilings and understands that they will be required to pay the necessary excess in the event of an accident.
8.12. In the event of late return as defined in Clause 7.2, any CDW will cease to apply should there not be a valid booking period extension and the Hirer will have to bear the full excess amount.
8.13. In the event where an accident is not reported within 24 hours to the appointed Accident Reporting Centre as required in Clause 4.4.7, any CDW will cease to apply and the Hirer will have to bear the full cost of the accident as stated in Clause 4.6 and be fully liable any associated recovery costs and loss of use charges for the vehicle.
8.14. In the event where a damage is not reported to the Live Chat before the booking ends, any CDW will cease to apply and the Hirer will have to bear the full cost of the damage repair as stated in Clause 4.6 and be fully liable for any associated recovery costs and loss of use charges for the vehicle.
8.15. Windscreen Excess covers the Hirer for damages to the vehicle’s windscreen. In the event of damage to or the replacement of the vehicle's windscreen, the Hirer shall pay an excess of $220 per claim.
8.16. Loss of use charges are determined by the vehicle’s Sat/ Sun and Public Holiday full day rate.
8.17. Loss of use charges and administrative fee are not covered by the insurance excess and the CDW.
9. Authorised Cross Border Use and Unauthorised Overseas Use
9.1. GetGo may, at its sole discretion, designate certain vehicles as eligible for cross-border use into West Peninsular Malaysia under the "Drive to Malaysia" service ("DTM"). A Hirer who is eligible and who expressly opts in to DTM during the booking process (an "Authorised DTM Booking") is authorised to operate the relevant vehicle within West Peninsular Malaysia for the duration of that booking, subject to Schedule 2 (Drive to Malaysia Terms). This authorisation does not extend to East Malaysia (Sabah or Sarawak), Thailand, or any other territory outside Singapore and West Peninsular Malaysia.
9.2. The rights, obligations, fees, insurance treatment, and other terms specific to Authorised DTM Bookings are set out in Schedule 2, which forms part of, and is incorporated by reference into, this Agreement.
9.3. Any use of a GetGo vehicle outside Singapore that is not an Authorised DTM Booking constitutes a breach of this Agreement and is deemed "Unauthorised Overseas Use." A Hirer engaged in Unauthorised Overseas Use is NOT covered by insurance for any period during which the vehicle is outside Singapore.
9.4. Should GetGo detect Unauthorised Overseas Use, a penalty of S$1,000 will be charged to the Hirer.
9.5. In the event of an accident occurring during Unauthorised Overseas Use, the Hirer will be fully liable for all costs and claims relating to the accident, without limit, and without any insurance or Collision Damage Waiver ("CDW") protection.
9.6. If GetGo is required to repossess or tow a vehicle back to Singapore following Unauthorised Overseas Use, GetGo will charge the Hirer a cross-border repossession fee of S$1,000 (in addition to the penalty in Clause 9.4), as well as any associated administration costs and loss-of-use charges for the vehicle.
9.7. For the avoidance of doubt, nothing in this Section 9 or Schedule 2 permits use of a GetGo vehicle in any location, manner, or purpose otherwise prohibited under Clause 2.5 or 2.6 (including off-road driving, racing, or illegal use), whether the booking is an Authorised DTM Booking or otherwise.
10. Traffic and Parking Violations, and Fines
10.1. The Hirer will be responsible for any breach of traffic rules, parking rules, and regulations during the booking period. In the case of Co-drive bookings, the Primary Driver shall be responsible by default for any such breach, provided that GetGo reserves the right to hold the Additional Driver solely or jointly liable where GetGo determines, based on its internal investigation or external evidence (including telematics or traffic camera footage), that the breach was attributable in whole or in part to the Additional Driver.
10.2. Should GetGo receive a ticket, fine, or penalty in connection with the use of the vehicle by the Hirer, GetGo will send the relevant Hirer’s information to the relevant authorities as the relevant person who was operating and using the vehicle and charge the Hirer a processing fee of $20 via his or her debit / credit card / PayNow, or request for payment of this processing fee via PayNow to 202024592Z.
10.3. In the case of Co-drive bookings, should GetGo receive a ticket, fine, or penalty, GetGo will by default send the Primary Driver's information to the relevant authorities.
10.4. The Hirer acknowledges and agrees to allow GetGo to provide his/her identity details to any law enforcement authority on request and/or otherwise in connection with any breach of applicable laws by the Hirer and/or the users of the vehicle.
10.5. The responsible Hirer must pay for all tickets, surcharges, tolls, fines, and penalties imposed from the use of the GetGo vehicle during the booking period.
10.6. Should the Hirer cause any GetGo vehicles to be impounded, towed, and/or disabled through wheel clamp or any other means, GetGo will impose an administrative fee of S$300 on top of any associated recovery costs and loss of use charges for the vehicle.
10.7. Loss of use charges are determined by the vehicle’s Sat/ Sun and Public Holiday full day rate.
11. Limitation of Liability
11.1. The Hirer shall indemnify and hold GetGo and its officers, directors, employees, and agents harmless from and against all reasonable costs, expenses, or damages that GetGo may suffer or incur, arising out of or in connection with the Hirer’s breach of this Agreement, including the costs of repair, repossession, or recovery, except to the extent caused by GetGo’s own default or negligence.
11.2. The Hirer acknowledges and agrees that the use of a vehicle involves the risks of death, injury and property damage, and the Hirer accepts all such risks arising out of or in connection with the use of the vehicle.
11.3. To the fullest extent permitted under applicable laws, save in respect of death or personal injury caused by the negligence of GetGo, GetGo shall not be liable to the Hirer, or any other person or entity for any direct, indirect, special, incidental, consequential or exemplary damages (including, but not limited to, damages for loss of profits, loss of data, loss of use or costs of obtaining substitute services) arising out of the use, inability to use (including without limitation due to any cancellations or amendments of bookings by GetGo under Clause 6), unauthorised access to or use or misuse of the services provided under the GetGo App, whether based upon warranty, contract, tort (including negligence), or otherwise, even if GetGo has been advised of the possibility of such damages or losses.
11.4. To the fullest extent permitted under applicable laws, save in respect of death or personal injury caused by the negligence of GetGo, the Hirer unconditionally releases and discharges GetGo from all claims and liability, under contract, tort, negligence, equity, statute or otherwise, which the Hirer now have or may have in the future, arising out of or in connection with the Hirer’s use of the vehicles.
11.5. Notwithstanding the above, to the fullest extent permitted under the applicable laws, GetGo’s aggregate liability for all claims arising from this Agreement (if any) to a relevant Hirer shall not exceed (i) the aggregate amount which the relevant Hirer had paid to GetGo in relation to the use of the GetGo App and/or vehicle, or (ii) S$100, whichever is lower.
11.6. GetGo shall not be liable for any failure or delay in the performance of its obligations under this Agreement to the extent caused by events beyond its reasonable control, including floods, landslides, road or border closures, civil unrest, or acts of any governmental or regulatory authority.
12. Personal Data Protection Act
12.1. This Personal Data Protection Policy notice for personal data ("Notice") is issued to GetGo’s Hirers, pursuant to the statutory requirements of the Personal Data Protection Act 2012 ("PDPA").
12.2. GetGo recognizes the importance of the personal data Hirers have entrusted to it and understands its responsibility to properly manage, protect and process the personal data of Hirers.
12.3. During the Hirer’s course of dealing with GetGo, GetGo may have, and / or will collect, use, disclose and process Hirers’ personal data for purposes, including, communicating; providing services, responding to your enquiries or complaints, provide you with information and/or updates on products, services and/or promotions offered by GetGo and/or its associated and its subsidiary companies or any selected third parties and other purposes required to operate and maintain business as set out in GetGo’s Personal Data Protection Policy.
12.4. In order to conduct GetGo’s business operations, GetGo may also be disclosing the personal data provided by Hirers to GetGo’s third party service providers, agents and/or GetGo’s affiliates and/or subsidiary companies or related corporations, and/or other third parties whether sited in Singapore or outside of Singapore, for one or more of the above-stated purposes.
12.5. Such third-party service providers, agents and/or affiliates or related corporations and/or other third parties would be processing your personal data either on GetGo’s behalf or otherwise, for one or more of the above-stated purposes.
12.6. GetGo has the right to request for access to, or to request for a copy of and to request to update or correct the Hirer’s personal data held by GetGo.
12.7. The Hirer has the right at any time to request GetGo to limit the processing and use of his/her personal data. (For example, requesting GetGo and/or its related companies to stop sending the Hirer any marketing and promotional materials or contacting Hirer for marketing purposes.)
12.8. The Hirer’s written request shall be sent to hello@getgo.sg to unsubscribe for future updates / promotions.
12.9. By submitting personal data to GetGo, the Hirer consents to GetGo collecting, using, disclosing and processing your personal data in accordance with Section 12 of this Agreement.
12.10. The Hirer warrants that all personal data provided by the Hirer is accurate and complete, and that none of it is misleading or out of date.
12.11. The Hirer will promptly update GetGo in the event of any change to his or her personal data.
12.12. In some circumstances, the Hirer may have provided personal data relating to other individuals (such as his/her spouse, family members or other third-party including minors) to GetGo. The Hirer represents and warrants to GetGo that (i) he/she is authorised to provide third parties’ personal data to GetGo, and (ii) the Hirer has obtained the consent of the relevant third parties for the collection, use, disclosure and processing of the third parties’ personal data in accordance with this section.
12.13. The Hirer acknowledges and agrees that GetGo may collect GPS location and telematics data in respect of any booking, including an Authorised DTM Booking, for operational, safety, investigation, and enforcement purposes.
12.14. Where the Hirer fails to pay any amount due under this Agreement, GetGo may, subject to applicable laws, disclose the Hirer's information and default details to any credit bureau or debt collection agency. The Hirer expressly consents to such disclosure.
13. Dispute Resolution and Governing Law
13.1. This Agreement is governed by and construed in accordance with the laws of Singapore.
13.2. GetGo and the Hirer hereby submit any disputes arising out of or in connection with this agreement to the exclusive jurisdiction of the courts of Singapore.
13.3. If any term of this agreement is, in whole or in part, held to be illegal or unenforceable to any extent under any enactment or rule of law, that term or part shall to the extent be deemed not to form part of this agreement and the enforceability of the remainder of this agreement shall not be affected.
13.4. In the event of a dispute between the Primary Driver and the Additional Driver regarding the cause of damage, a traffic violation, or any financial liability:
13.4.1. GetGo shall not be required to adjudicate or mediate the dispute between the two parties.
13.4.2. The Primary Driver shall remain the party primarily responsible for all payments, including but not limited to insurance excess, repair costs, and administrative fees.
13.4.3. and in the absence of a clear written admission of guilt by one party or conclusive evidence from GetGo’s internal telematics and/or external footage , the Primary Driver shall be deemed the default debtor for all outstanding sums. This includes, but is not limited to, insurance excess, repair costs, administrative fees, and legal expenses. The Primary Driver’s liability is primary and immediate, and GetGo shall not be required to withhold billing or collection efforts pending the resolution of any private dispute or legal action between the Primary Driver and the Additional Driver.
14. Paid Subscription Services
14.1. GetGo may offer subscription-based plans (“Subscription” or “Subscription Services”) that provide Hirers with access to certain benefits, features, or discounted rates within the GetGo App.
14.2. By enrolling in a Subscription, the Hirer acknowledges that the Subscription is personal to the Hirer’s GetGo account and is non-transferable.
14.3. To subscribe, the Hirer must have an active GetGo account.
14.4. Subscription Fees
14.4.1. Subscription Fees are payable on a recurring basis based on the option selected at the point of purchase.
14.4.2. Upon successful sign-up, the Subscription Fee will be charged immediately to the Hirer’s selected payment method.
14.4.3. Subsequent Subscription Fee charges will be processed automatically on the renewal date using any active payment method linked to the Hirer’s GetGo account.
14.4.4. To ensure uninterrupted Subscription Services, GetGo may initiate payment authorisation or charge attempts up to two (2) days before the billing renewal date.
14.4.5. The Hirer acknowledges and agrees to allow GetGo to automatically charge the Subscription Fee and any applicable taxes to the Hirer’s stored payment method without further consent.
14.4.6. The Hirer is responsible for ensuring that their payment details remain valid before the renewal date.
14.4.7. GetGo may modify the Subscription Fees, billing cycle, benefits, or associated terms at any time at its sole discretion.
14.4.8. The Hirer’s continued Subscription use after such modifications will constitute acceptance of the updated terms.
14.5. Failed Payment
14.5.1. If a Subscription Fee charge attempt fails due to insufficient funds or any other reason, GetGo may retry the charge using the same payment method or other payment methods linked to the Hirer's account;
14.5.2. GetGo may terminate the Hirer’s Subscription until payment is successfully collected.
14.6. Subscription Benefits
14.6.1. GetGo may modify, replace, or discontinue any Subscription benefit at any time at its sole discretion.
14.6.2. Continued use of the Subscription after such changes will constitute acceptance of the updated benefits and/or terms.
14.6.3. GetGo may at times offer promotional pricing, limited-time discounts, or trial periods for Subscription Services.
14.6.4. Unless expressly stated, promotional or trial Subscriptions will convert into paid Subscriptions at the standard rate upon expiry, and the Hirer consents to automatic billing as per Clause 14.4.3.
14.6.5. GetGo reserves the right to revoke, amend, or terminate promotions or trials due to misuse or breach of this Agreement.
14.7. Cancellation of Subscription
14.7.1. The Hirer may cancel a Subscription at any time via the App.
14.7.2. Cancellations take effect at the end of the current billing cycle. No refunds (pro-rated or otherwise) will be provided for the remaining period.
14.7.3. After cancellation, the Hirer will continue to receive Subscription benefits until the end of the paid billing cycle.
14.7.4. Once the cancellation takes effect at the end of the billing cycle, the subscription benefits will cease immediately.
14.8. Refund Policy
14.8.1. All Subscription Fees are strictly non-refundable.
14.8.2. No refunds, credits, or extensions will be provided for unused benefits, accidental subscription activations, or failure to cancel before renewal.
14.9. Termination by GetGo
14.9.1. GetGo may suspend or terminate a Subscription with immediate effect if the Hirer breaches this Agreement, misuses the Subscription benefits, or engages in fraudulent activity.
14.9.2. In the event of termination due to such breaches, no refunds or credits will be provided.
SCHEDULE 1 – COMMUNITY GUIDELINES, PENALTIES, CHARGES, AND IMPLICATIONS
In the event of an accident, GetGo reserves the right to collect the full excess amounts based on the following table. The overview of the type of fees can be summarised in the table below.
SCHEDULE 2 — DRIVE TO MALAYSIA TERMS
This Schedule sets out the terms specific to Authorised DTM Bookings under Section 9. It is incorporated by reference into, and forms part of, the Agreement. In the event of any conflict between this Schedule and the main body of the Agreement in respect of an Authorised DTM Booking, this Schedule shall prevail to the extent of the conflict.
1. Application and Eligibility
1.1. This Schedule 2 applies to any booking in which the Hirer has opted in to DTM and such booking has been confirmed by GetGo as an Authorised DTM Booking under Clause 9.1.
1.2. GetGo may restrict DTM eligibility to specific vehicle tiers, vehicle types, or Hirer risk profiles at its sole discretion.
1.3. The geographic scope is limited to West Peninsular Malaysia. Use in East Malaysia (Sabah, Sarawak), Thailand, or any other territory is Unauthorised Overseas Use under Clause 9.3, regardless of the booking type.
1.4. For the avoidance of doubt, the general prohibitions in Clauses 2.5 and 2.6 (including off-road driving) continue to apply in full.
2. Fees
2.1. A DTM Surcharge of 30% of the applicable Time Charge applies to Authorised DTM Bookings, subject to a maximum daily cap that varies by vehicle tier and by weekday, weekend, or public holiday. The applicable surcharge and cap for a given booking shall be as displayed on the GetGo App at the time of booking (Clause 5.8).
2.2. No Mileage Charge applies (Clause 5.9). The Hirer is solely responsible for all fuel costs in Singapore and Malaysia, with no fuel reimbursement.
2.3. A Fuel Shortage Charge of S$35 per quarter-tank shortfall applies where returned with less than half a tank (Schedule 1).
2.4. The Hirer is solely responsible for all Malaysian tolls, Touch 'n Go charges, Road Charges, customs fees, and any other governmental charges, in addition to Clause 10.5.
2.5. Where the vehicle is an EV, the Hirer is solely responsible for all charging costs, idle fees/penalties, and any costs from charging-infrastructure incompatibility in Malaysia.
2.6. The Hirer is fully responsible for all repair, recovery, and associated costs from use of incorrect fuel or charging methods.
3. Insurance & CDW
3.1. CDW is doubled relative to the standard Singapore charge for the relevant tier/option (Clause 8.6).
3.2. Coverage is subject to full compliance with this Schedule, Section 9, and Clause 4, including reporting any accident to the authority in the Malaysian state where it occurred within 24 hours (Clause 4.4.7).
3.3. Coverage does not extend to East Malaysia, Thailand, or any territory outside West Peninsular Malaysia, or to any use inconsistent with Clause 2.5 or 2.6.
4. Overseas Recovery, Detention, and Seizure
4.1. Without limiting Clause 2.8, the Hirer is fully responsible for all overseas towing, roadside assistance, recovery, transportation, storage, customs, repatriation, accommodation, logistics, and other costs reasonably incurred by GetGo.
4.2. Where the vehicle is detained, impounded, seized, or withheld by any Malaysian governmental authority, the Hirer remains fully liable for all release fees, storage charges, transportation costs, legal costs, administrative costs, penalties, and associated losses.
4.3. The Hirer is liable for all costs from tyre punctures, damage, replacement, and related roadside assistance/towing, in Singapore or Malaysia.
5. Accident, Breakdown, and Roadside Matters
5.1. GetGo is not responsible for, and won't compensate for, delay, cost, or loss from immigration processing, customs clearance, border congestion, road closures, or acts of a Malaysian or Singapore authority.
6. Restricted Areas and Conditions
6.1. Authorised DTM Bookings are restricted to West Peninsular Malaysia only (Clause 9.1).
6.2. Clause 2.5's restrictions apply without modification and extend to equivalent terrain encountered in Malaysia (construction sites, plantations, beaches, flooded roads).
7. Force Majeure
7.1. In addition to Clause 11.6, GetGo is not liable for failure or delay caused by floods, landslides, road or border closures, civil unrest, or acts of a governmental authority in Singapore or Malaysia.
8. Data Collection
8.1. The Hirer acknowledges GetGo may collect GPS and telematics data for operational, safety, investigation, and enforcement purposes, per Section 12.
9. General Indemnity
9.1. Without limiting any specific indemnity above or elsewhere, the Hirer shall fully indemnify GetGo against all losses, costs, and expenses from use of the vehicle outside Singapore under an Authorised DTM Booking, except to the extent caused solely by GetGo's negligence.
